North Carolina mother to sue school and hospital administration for administering COVID-19 vaccine to his son without consent
A state Supreme Court in North Carolina has ruled in favor of a mother and his son to sue a public school system and a doctors’ association for allegedly giving the boy COVID-19 vaccine without consent.
Emily Happel and her son Tanner Smith can now her son’s school and a state doctor’s association after they had initially been denied by the decision of a lower court.

In August 2021, 14-year-old Tanner went to the clinic to be tested for COVID-19 after several cases among his peers. He told staff at the clinic that he did not want a vaccination, and he did not have a signed parental consent form to receive one.
The clinic however ignored his plea after they were unable to reach his mom. According to Happel and Smith, one worker instructed a colleague to “give it to him anyway.”

Happel and Smith filed the lawsuit against the Guilford County Board of Education and the Old North State Medical Society.
The mother and son made accusations of battery and alleged that their constitutional rights were violated.
